2. Intellectual Property Rights

All elements comprising the Beard Up application, including text, illustrations, interfaces, logos, source codes, designs, videos, and sounds, are the exclusive property of JDM DIGITAL. Any reproduction, distribution, or modification without written authorization is strictly prohibited and may result in legal action.

3. User Declarations and Obligations

By using the Application, you represent and warrant that:

You have the legal capacity and you agree to comply with these Terms of Use;
You are not under 13 years old
you are not a minor in the jurisdiction in which you reside, or if you are a minor, you have received parental permission to use the Application
you will not access the Application through automated or non-human means, whether through a bot, script or otherwise
you will not use the Application for any illegal or unauthorized purpose; and
Your use of the Application will not violate any applicable laws or regulations.

4. Prohibited Activities

The user undertakes not to:
(a) circumvent or violate security measures;
(b) disrupt the operation of the Application;
(c) use any scripts, bots or automated systems;
(d) publish abusive, defamatory or unlawful content;
(e) violate the intellectual property rights of JDM DIGITAL or third parties.

5. User Contributions

The Application may allow you to post, submit or share content, including personal photos, before/after images, comments, suggestions or any other data generated in the course of using Beard Up (the “Contributions”).

These Contributions may bevisible to other users or used to illustrate certain features (e.g.: progress tracking, community feedback).

By submitting a Contribution, you guarantee:

be the author or have the necessary rights,
accept that she be treated asnon-confidential,
authorize JDM DIGITAL to use, display or delete it, within the limits provided by law.

We reserve the right tomoderate or deleteany content that does not comply with our rules or the law.

6. Contribution License

By posting your Contributions to any part of the Application, you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions (including, without limitation, your image and voice) for any purpose, commercial, advertising, or otherwise, and to prepare derivative works of, or incorporate into other works, such Contributions, and grant and authorize sublicenses of the foregoing.

7. Mobile Application License

License to Use

If you access the Services through the AppBeard Up, we grant you personal, revocable, non-exclusive, non-transferable, limited license to install and use the application on a mobile device that you own or control, and to access its features in strict compliance with these General Conditions of Use.

You agree not to:

decompile, disassemble or attempt to derive the source code of the Application, except as legally permitted;
modify, adapt or create derivative works from the Application;
use the application for purposes that are illegal or contrary to public order;
remove or hide intellectual property notices (copyright, trademark, etc.);
use the Application to generate unauthorized revenue or for any devious commercial purpose;
make the application available on a network allowing simultaneous use by multiple devices or users;
use the application to develop a competing or similar product;
send automated requests or unsolicited messages through the Application;
use any protected element (interface, code, design, etc.) for external development purposes, without written authorization from JDM DIGITAL.

Specifics for Apple (iOS) users

When you download the application via theApple Store :

The license granted to you is limited to apersonal use on an iOS device, in accordance with the App Store Terms of Service.
JDM DIGITAL issolely responsible for the maintenance and support of the application, and Apple does not provide any specific warranty or support.
In the event of a serious malfunction, you can contact Apple who will be able torefund the purchase, if applicable, but assumes no other liability.
You declarenot reside in a country under US embargo, nor be on any U.S. government prohibited list.
You must respectthe conditions of third-party platforms(Apple, Stripe, Firebase…) when using the application.
Apple is considered athird-party beneficiaryof these conditions, and may assert its rights with regard to them.

8. Third-Party Sites and Content

Services offered via the applicationBeard Upmay contain (or redirect you to) links to other third-party websites or services (the “Third-Party Sites”), as well as content from external sources, such astexts, images, videos, music, graphics, applications, plugins, analysis tools or advertisements(collectively, “Third Party Content”).

We do not control, endorse, or guarantee the accuracy, quality, or reliability of these third-party sites or content. Accessing, viewing, or using these resourcesis done under your sole responsibility.

The inclusion of a third-party link or element within Beard Updoes not imply in any way our endorsement or responsibilityas to their content, privacy policy, terms of use or business practices.

If you choose to interact with a third-party site, install an external service, or make a purchase through an outbound link:

you are solely responsible for this interaction,
Beard Up et JDM DIGITAL declines all responsibilityas to your experience or the consequences of this use,
these General Conditions no longer apply.

Any purchase made from a third partyis strictly governed by its own terms and conditions. You acknowledge thatJDM DIGITAL is not a party to these transactions, neither responsible for the products or services offered, nor required to assist you in the event of a dispute.

9. Advertising

The application does not currently display advertising. However, JDM DIGITAL reserves the right to integrate advertising spaces in the future under conditions that are transparent to the user.

10. Application Management

JDM DIGITAL reserves the right, but is not obliged to:

monitor the use of the Beard Up application in order to detect any violation of these General Conditions of Use;
take all appropriate legal action against any user who, in our sole judgment, violates the law or these T&Cs, including, without limitation, reporting the user to the appropriate authorities;
restrict, limit or disable access to all or part of a user's content or contributions, without notice, if they affect the proper functioning of the application or contravene our rules;
delete or disable any file or content deemed excessive in size or technical load, or affecting the stability of the application or data security;
manage, update and adapt the application in such a way as to protect the rights, resources and reputation of JDM DIGITAL, and to ensure an optimal user experience.

technical updates,

You acknowledge that interruptions in access may occur at any time, including in the event of technical malfunctions, necessary updates or circumstances beyond our control.

Accordingly, you agree that JDM DIGITAL cannot be held liable for any loss, damage or harm resulting from:

or a permanent cessation of associated services.

No compensation may be claimed in the event of suspension or termination, whether temporary or permanent.

17. Purchases and Payments

Paid subscriptions to the applicationBeard Up(weekly, monthly or lifetime) are exclusively available via the official download platforms:

On iOS: Payments are processed via theApple App Store, in accordance with its general conditions.
On Android: Payments are processed via theGoogle Play Store, in accordance with its general conditions.

You agree to provide accurate and up-to-date payment information.
Taxes may be added to the displayed price depending on your country of residence.

All payments aremanaged directly by Apple or Google.
You authorize these platforms to debit your account in accordance with the type of subscription chosen (automatic renewal where applicable).

JDM DIGITAL does not access any banking or credit card data.
Any request regarding payment, refund or subscription management must be addressed directly to the platform used (Apple or Google).

18. Cancellation

The user can cancel their subscription at any time via their account settings. The cancellation takes effect at the end of the current subscription period.
No refunds are made unless otherwise provided by law.

Consequently, JDM DIGITAL cannot be held responsible for any physical, moral, aesthetic or economic damage resulting from the use of the application, the following of the recommendations proposed or a misinterpretation of the contents.

(4) interruptions of service, transmission or technical failures;
(5) the transmission of viruses, Trojan horses or malicious elements by a third party;
(6) or any loss, harm or damage resulting from the use of the Application or any content accessible from it.
